Welcome to Fastaffer, a platform provided by Bifixit and Technology Solutions Limited that connects employers in the USA with short-term staff (“Fastaffs”) from African countries, including Nigeria, Kenya, Rwanda, and South Africa. These Terms and Conditions govern your use of our platform and services. By accessing or using Fastaffer, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our platform.
1. Definitions
- “Platform” refers to the Fastaffer website and mobile application.
- “Employer” refers to any individual or business in the USA using Fastaffer to hire temporary staff.
- “Fastaff” refers to any worker registered on Fastaffer from African countries for short-term employment opportunities.
- “We”, “Us”, or “Fastaffer” refers to Bifixit and Technology Solutions Limited.
- “Staff Assignment” refers to the process by which Fastaffer assigns a Fastaff to an Employer.
2. Eligibility
To use Fastaffer, you must:
- Be at least 18 years old.
- Have the legal authority to enter into a binding contract.
- Agree to comply with these Terms.
Fastaffer reserves the right to verify the eligibility of users at any time.
3. Services
Fastaffer provides employers with temporary staff (Fastaffs) for a minimum of 30 days. Fastaffer manages the entire hiring process, including staff selection, assignment, and re-assignment if necessary. Employers interact directly with the staff assigned to them through the Fastaffer platform.
Employer Responsibilities:
- Employers must provide accurate job descriptions and expectations for assigned staff.
- Payments must be made through the platform to initiate staff assignments.
- Employers may not contact Fastaffs outside the platform or engage them for work bypassing Fastaffer.
Fastaff Responsibilities:
- Fastaffs must perform the assigned job duties as per the Employer’s instructions and expectations.
- Fastaffs must log in during assigned work hours and report their activities via the platform.
- Any underperformance or violation of job expectations may result in re-assignment or termination.
4. Staff Assignment
Once payment is completed, Fastaffer will assign a Fastaff to the Employer for the requested job. The Employer may not select specific individuals, but will receive staff based on the skills required for the role.
Fastaffer retains the right to:
- Reassign staff if the assigned Fastaff is deemed underperforming.
- Replace staff in cases of unforeseen circumstances.
5. Payment and Billing
All payments for staff assignments must be made through Fastaffer. Employers are required to pay the full amount upfront for the stipulated minimum 30-day assignment.
- Payments are processed through secure third-party payment gateways.
- Fastaffs will be paid by Fastaffer on a monthly basis based on the work completed.
- Employers are responsible for any additional fees that may be applied during the course of the engagement.
Fastaffer is not responsible for any disputes between Employers and Fastaffs outside of the platform.
6. Cancellation and Refund Policy
- Employers may cancel a staff assignment within 24 hours of payment, and a full refund will be issued.
- After 24 hours, cancellations are not eligible for a refund.
- Fastaffer reserves the right to cancel staff assignments in cases of fraud, misuse, or violation of these Terms.
7. Communication and Monitoring
Employers and Fastaffs are required to communicate through the Fastaffer platform. Sharing of personal contact information (such as phone numbers or emails) outside of the platform is prohibited.
Fastaffer may monitor communications to ensure compliance with these Terms and for quality control.
8. Confidentiality
Both Employers and Fastaffs agree to keep any confidential information shared during the course of the assignment private and secure. This includes business processes, client information, and any proprietary information disclosed by the Employer.
9. Intellectual Property
All content, features, and functionality on Fastaffer (including but not limited to text, graphics, logos, images, and software) are the exclusive property of Bifixit and Technology Solutions Limited. Users may not reproduce, distribute, or create derivative works based on Fastaffer content without express permission.
10. Termination
Fastaffer reserves the right to terminate access to the platform for any user who violates these Terms or engages in fraudulent, abusive, or illegal activities.
- Employers and Fastaffs may terminate their account at any time by notifying Fastaffer.
- Any outstanding payments or unresolved assignments must be settled before termination.
11. Limitation of Liability
Fastaffer is a platform for supplying Employers with temporary staff. We are not responsible for any direct or indirect losses, damages, or liabilities arising from:
- Performance or non-performance of Fastaffs.
- Miscommunication or disputes between Employers and Fastaffs not reported within 24 hours.
- Misuse of the Fastaffer platform.
Fastaffer’s total liability is limited to the total amount paid by the Employer for the assignment in question.
12. Indemnification
You agree to indemnify and hold Fastaffer harmless from any claims, damages, or losses (including attorney fees) arising from:
- Your use of the platform.
- Your violation of these Terms.
- Any unreported disputes between Employers and Fastaffs.
13. Amendments to These Terms
Fastaffer reserves the right to update or modify these Terms at any time. Users will be notified of any significant changes, and continued use of the platform constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the United States of America. Any legal disputes arising from the use of Fastaffer shall be resolved in the courts of the United States.
